KBS New Student Referral Program T&C'S
TERMS & CONDITIONS (T&Cs) – Version 1.0 (March 2026)
1. About the Program
- Kaplan Business School Pty Ltd (“KBS”) values individuals who share their positive experience or genuine interest in studying at KBS with friends and family.
- KBS may, from time to time and in accordance with these T&Cs, provide a reward (e.g., a gift card, voucher or tuition fee discount) to KBS students, alumni or CoE holders (defined below) who personally recommend KBS to a friend or family member if that referral results in a new full-time onshore enrolment in an Award course that remains enrolled past the relevant census date.
- This referral program (“Program”) is for genuine personal recommendations only. It does not create any representative, agency, employment or contractor relationship.
- This Program is subject to these T&Cs. By submitting a referral to KBS, the Referrer (defined below) accepts these T&Cs and warrants their compliance with them.
2. Who can refer
- This Program is open to:
(i) current KBS students;
(ii) KBS alumni; and
(iii) holders of a Confirmation of Enrolment issued by KBS (“CoE holders”). - A person who submits a referral under this Program is called a “Referrer”.
- A Referrer must:
(i) be an individual;
(ii) act in his or her personal capacity only;
(iii) not be, or act as, an education agent;
(iv) not be employed by, contracted to, or affiliated with an education agent; and
(v) not make referrals as part of any business, organised or commercial activity. - A Referrer cannot refer themselves.
- A Referrer cannot be a current staff member of any Kaplan entity.
3. Who can be referred
- For KBS to consider a referral, the person referred by the Referrer must:
(i) be legally in Australia at the time the referral is submitted;
(ii) if studying with another education provider, be eligible to transfer to KBS;
(iii) not be represented by an education agent at the time the referral is submitted;
(iv) be applying for full-time study in an Award course (for example, Diploma, Graduate Certificate, Graduate Diploma, Bachelor and Master level courses, but not ELICOS, Study Abroad or Single-Subject Enrolments); and
(v) be genuinely new to KBS, meaning they are not already known to KBS (e.g., they must not be a previous applicant or listed in a KBS database). - KBS will determine, in its sole discretion, whether these requirements are satisfied.
4. How referrals work
- Referrals must be submitted via KBS’s nominated referral webpage for this Program.
- The Referrer’s role is limited to providing the name and contact details of the referred person to KBS.
- KBS will deal directly with the referred person and conduct all steps of the recruitment process, including contacting them about potentially studying at KBS, providing marketing and course information, encouraging them to apply, and (if applicable) managing their enrolment. The Referrer will not be involved in these matters.
- KBS does not guarantee that it will pursue, progress or respond to any referral. Any decision to contact a referred person, invite an application, assess an application or offer enrolment remains at all times a matter for KBS in its sole discretion.
- A Referrer must not:
(i) represent themselves as an agent, employee or other representative of KBS;
(ii) provide admissions, course, visa, migration or any other advice to the referred person or any other person seeking to study in Australia or overseas;
(iii) request or assist the referred person to submit an application to KBS; or
(iv) collect documents or handle payments for the referred person. - By submitting a referral, the Referrer confirms that:
(i) they have obtained the referred person’s consent to share their details with KBS for KBS to contact them about potentially studying at KBS;
(ii) they have disclosed to the referred person that they (i.e., the Referrer) may receive a reward from KBS in connection with the referral;
(iii) the person is a genuine friend or family member with whom they have a pre-existing personal relationship; and
(iv) the person has indicated they may be interested in studying at KBS. - Referrers may share their genuine personal KBS experiences in the ordinary course, including on social media. However, referrals must not be artificially arranged, exchanged, purchased, generated through promotional activity (paid or unpaid), or the result of public calls for referrals or bulk or systematic outreach.
5. Referral limit
- A Referrer may receive recognition for up to three (3) successful referrals in total. b) KBS may approve additional referrals in exceptional circumstances at its discretion.
6. Reward
- If the Referrer has complied with these T&Cs and a person referred by the Referrer:
(i) applies and enrols for full-time study in an Award course directly with KBS
(ii) pays all relevant tuition and other fees to KBS by the applicable due dates;
(iii) remains enrolled with a full-time study load past census in their first full/standard trimester study period with KBS (note: if the person referred commences in an accelerated (X) trimester, they must remain enrolled past census in the full/standard trimester that follows that X trimester); and;
(iv) satisfies all other relevant requirements in these T&Cs, then KBS may, in its sole discretion, provide a reward to the Referrer. - The form of the reward (if any) will be determined by KBS.
- A reward is non-transferable and not redeemable for cash.
- If the Referrer is a KBS CoE holder or current student of KBS, any reward will only be provided if (in addition to the other requirements in these T&Cs) the Referrer remains enrolled at KBS at the time KBS determines to provide a reward to the Referrer, unless they have already successfully completed their course.
- KBS will determine, in its sole discretion, whether a referral qualifies and whether a reward will be provided.
- For the avoidance of doubt, nothing in this Program obliges KBS to contact, accept or enrol any referred person or take any other steps in response to a referral.
7. Program integrity
- KBS may decline, withhold or recover a reward, or exclude the Referrer or any referred person from this Program, if it determines (in its sole discretion) that:
(i) the Referrer is or may be undertaking the activities of an education agent;
(ii) the referral does not reflect a genuine personal recommendation;
(iii) the referral was generated through organised or promotional activity;
(iv) the referral information is incomplete, inaccurate or misleading, the Referrer did not refer the referred person to KBS, or the referred person was represented by an education agent at the time the referral was submitted;
(v) multiple Referrers claim the same referred person; or
(vi) a law, regulation, code or other requirement (however described) to which KBS is bound or subject prohibits KBS from providing a reward to the Referrer in connection with the referred person or generally. - The Referrer must not request or accept any payment or benefit from the referred person (or anyone else, other than a reward from KBS) in connection with a referral.
8. Privacy
- KBS will handle personal information in accordance with its Privacy Policy (accessible via its website) and applicable privacy laws.
9. Changes to the Program
- KBS may amend, suspend or terminate this Program at any time without notice.
- The applicable version of these T&Cs for a referral is the version published on KBS’s website at the time the Referrer submits the referral to KBS via the relevant webpage.
10. General
- Participation in this Program is voluntary.
- To the extent permitted by law, KBS is not liable to the Referrer in connection with this Program, including for any claim, loss, damage or expense incurred by the Referrer.
- Referrers are responsible for any tax implications associated with receiving a reward.
- These Terms are governed by the laws of New South Wales, Australia.
